Introduction
Actim s.r.l. (“Actim”) takes your privacy very seriously and commits to respect it to the best of its ability. When you (“the User”) visit the Site or request services available on the Site (such as, but not limited to, download of documents or use of the contact form) Actim may process your personal data. This Privacy Policy (“Privacy Policy”) outlines the activities carried out by Actim in the processing of personal data performed through its websites (“Website” or “Site”) and the relevant obligations carried out by Actim.
This Privacy Policy is compliant with Recommendation No. 2/2001, adopted on 17 May 2001 by the European Union’s WP9 – Working Group for the Protection of Personal Data – Art. 29, in relation to the minimum requirements for online data collection in the EU. This Privacy Policy also constitutes an information notice to the User according to the meaning and pursuant to Section 13 of the Italian Legislative Decree No. 196/2003 and its subsequent amendments and integrations (“Italian Personal Data Protection Code”).
The Privacy Policy includes information on the Data Controller who controls and manages the personal data collected and processed through the Website and indicates elements such as: type of personal information collected, purposes and methods of data processing, scope of possible disclosure of the User’s personal data to third parties, the safety measures adopted in order to protect and safeguard the above data, as well as the methods available to the User to verify which data of his/hers are processed and how to exercise the rights provided for by the Italian Personal Data Protection Code.

Type of Data Processed
Visiting or consulting the Website does not usually entail the collection and processing of personal data of the User, except for the “navigation data” and cookies, as detailed below. In accordance with its Privacy Policy, Actim might also collect the User’s personal data held by third parties.
In the sections of the Website where the User’s personal data are collected, a specific information notice is available, pursuant to Section 13 of the Italian Personal Data Protection Code: otherwise, the present Privacy Policy constitutes the information notice provided to the Users pursuant to Section 13 of the Italian Personal Data Protection Code. Wherever established by the Privacy Policy, the User’s consent will be requested before proceeding to process their personal data. If Users provide the personal data of third parties, they must undertake previous actions to ensure that the disclosure of third parties data to Actim (and the subsequent processing for the purposes specified in the information notice) is compliant with the Privacy Policy and with the applicable laws and regulations: for example, the User may provide the personal data of third parties only after having duly informed them and received the relevant consent to the processing of such data.
In addition to the so-called navigation information (see below), personal data voluntarily provided by the User may also be processed when the User interacts with the functions available on the Website.

What are cookies?

“Profiling” Cookies (not currently used on our site):
Profiling Cookies are used to track and profile users while browsing, understand their movements and habits of navigation on the site, and the web in general, as well as consumer habits, also in order to send targeted and personalized advertising services (so-called Behavioural Advertising).

Contrary to the first part of cookies, third-party cookies are generated and sent, in connection with third-party functionality on the site, by third parties unrelated to this website. For this reason, knowledge and control of these cookies, the data collected and the purposes for which they are used are extremely limited. These cookies may include functional, technical, analytical, profiling or advertising cookies. Third parties can use the information collected independently and for their own purposes.

Purposes and Methods of Data Processing
Actim may process the User’s personal data for the following purposes: management of communications from users; management of requests for information, delivering of promotional material and communications (including marketing), management of applications, etc.
Personal data are processed in both paper and electronic form and are entered into the company information system in compliance with the Italian Personal Data Protection Code and according to profiles of security and confidentiality, adhering to the principles of fairness and legality of data processing. Pursuant to Section 11 of the Italian Personal Data Protection Code, data are retained for the time strictly necessary for achieving the specific purpose of their collection.

Safety and Quality of Personal Data
Actim undertakes to protect safety of the User’s personal data and to fulfill the safety provisions as established by the applicable regulations in order to prevent loss of data, illegal or illicit use of the same, and unauthorised access to said data, with specific but not exclusive reference to Annex B of the Italian Personal Data Protection Code (Technical Product Specifications in relation to minimum safety). Areas of Personal Data Accessibility
Personal data will be accessible, within Actim, only to the personnel in charge of data processing that, in relation to their duties, require said data to process the User’s request. Data may be disclosed to third companies cooperating with Actim Group for the same purpose as stated above and/or for administrative purposes, pursuant to Section 34, Paragraph 1-ter, of the Italian Personal Data Protection Code.

Provision of Personal Data
The provision of certain personal data by the User is necessary for Actim to manage the communications, the applications received from the Site or the requests of Users (including but not limited to, requests of information, printed matters, etc), or to contact the User in connection with his/her request. Such type of data is marked by an asterisk (*) and the provision thereof is necessary to allow Actim to process the request.

The User may at all times exercise the rights provided for by Section 7 of the Italian Personal Data Protection Code, including for example, the right to obtain confirmation on the existence of his/her personal data, the right to check the content, the source and the exactness of his/her data, and/or to request update, erasure, de-identification of the data unlawfully processed, and to oppose the processing of such data for any legitimate reason. For any questions or requests regarding the processing of personal data by Actim and for exercising the rights provided for by the Privacy Policy, as well as to get the updated list of subjects to whom the data are disclosed, the User shall apply the Data Controller at the address stated above.
